TeeTMI
Editing to add the UPDATE: The Minister has announced. 'Applications for the Temporary Sponsored Parent visa will open in the first half of 2019.' There is an update to news on the 3 to 5 year Temporary Parent Visa that the government announced they expected to commence in November 2017. The associated Bill that was been delaying the introduction of the Temporary Parent Visa (3-5 years), [which is also expected to make changes to the Partner visa] has this morning passed Senate (it has taken approximately 2 years for it to reach this point). The related Bill that was delaying the Temporary Parent visa is the 'Migration Amendment (Family Violence and Other Measures) Bill 2016'. Two amendments have been added to the Bill, therefore it must now go back to the House of Representatives. If they agree to pass the Bill without any further amendments, once Royal Assent has been obtained it will become law. The amendments added on 27 November 2018: An additional Sponsor obligation: 'paying prescribed medical, hospital, aged care or other health-related expenses incurred by a visa holder or a former visa holder’; To change the commencement date from 1st July 2017 to another date (or within the period of 6 months after receiving Royal Assent). There is expected to be considerable interest in this visa option as the Balance of Family does not need to be met, we have been advised that there will be yearly quotas set for this visa. TeeTMI
Update: The amendments to the Bill were agreed to by Parliament yesterday. Once Royal Assent has been obtained (generally quick) then this legislation can become law at any point within the following 6 month period. RYLC
@TeeTMI just wondering whether there is a need to pass medical for this visa before being granted? I remember someone posting in the past about how to get his mother with dementia to Australia so that he didn’t have to move back to RSA. Is this visa suited to these scenarios or not. Just to give some general context for people. Obviously people can email you for their specific circumstances though.
TeeTMI
Hi RYLC There are Health Criteria to be met for all visas but whether a Medical will be a mandatory requirement for all will depend upon the legislation and policy behind the visa and that has not yet been published. Again within the visa application I would expect the applicant to be required to declare certain conditions and even if a Medical is discretionary that may prompt one to be requested. Whilst it is not clear at this stage the other issues that come to mind that may be an issue are that 1) the visa holder must hold Health Insurance and in the case of a significant health issue that may be difficult/costly to obtain and 2) the Sponsor will be held responsible for all costs incurred by the Australian government which may not be covered by health insurance. As I say we have not yet seen the full legislation/policy in relation to this. Some of the details we have to date: The visa may be renewed to allow a cumulative stay of up to ten years. As at July 2017 the cost of this visa was provided as: 3 year stream $5,000, 5 year stream $10,000. Initially this visa will be limited to a quota 15,000 visas / year. The Department will undertake a review of this new visa at the end of the first year. There are a number of eligibility requirements to apply for this visa. These include: The visa applicant must meet a number of selection criteria including health and character requirements The visa must be sponsored by a biological, adoptive, or a step-child, over the age of 18 The sponsor must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen, who has lived in Australia for at least 4 years The sponsor must meet the household income requirement and accept legal liability for any public health debt their sponsored parent accrues Edited November 28, 2018 by TeeTMI
