Is it advisable for us to apply as a couple or separately - that is, one application for the pair of us, or two separate applications?

Hi Juanita

A 136 application has a main applicant, either you or your husband, whoever is able to secure the most points. The other person is then a dependant of the main applicant. So you will actually have just one application. Hope that answers your question.

Mara is right- you will only need one application, with a main and secondary applicant. That is if you are married or de facto. In some instances if you are not married it may be advisable to apply separately.

Even if the couple is not married, so long as they are in a de-facto relationship, the partner must be declared as such in the application form.

So, unless you're not in a de-facto relationship and not married, there's little point in applying separately.

Please help me here - if you apply on a 136, you can prove the de facto relationship, after say six months in OZ your relationship goes done the drain, will both parties be able to stay on, or is it only the main applicant? Thnx for your help

The short answer is "Yes". -

When you apply for and are granted a 136 visa, all persons listed on the application are granted full permanent residency. So if the relationship goes down the drain, both persons would be able to stay in OZ.

It is an entirely different case for somebody who is granted a spousal visa. Usually, the visa is cancelled. But if there are special circumstances (such as spousal abuse), DIAC will consider allowing the sponsored person to stay.
