457 na 136 en SIR (495) na 136?

Hi Julle

Ons het nou die 138 roete probeer maar blykbaar sponsor die familie al klaar ander familie en sien hulle nie kans om vir die hele klomp sponsorsip te teken nie. Dis te verstane.

Aangesien ons nog 5 punte te min het vir 136. Wil ons net die volgende weet. As mens oorgaan op 'n 457 en jy werk 6 mde kry mens nie dan genoeg punte vir werk in Auz om dadelik aansoek te doen vir 'n 136 nie ?

En as mens met 'n SIR oorgaan kan mens na 6 mde aansoek doen vir 'n 136 vir dieselfde rede, omdat mens nou genoeg punte het omdat mens nou in Auz werk?

Of tas ons nou in die duister rond?

dit verskil van staat tot staat .In wes australia werk hulle glad nie volgens die punte stelsel nie ,dis nou as jy op n tydelike visa is en jy wil aansoek doen vir die permanente visa.

Jy kan nie aansoek doen vir 'n 136 as jy klaar op 'n SIR visa die land ingekom het nie. Die enigste manier om van die SIR na 'n permanente visa te gaan (ek dink) is as jy jou werkgewer kan kry om jou te sponsor vir 'n permanente visa. Ek weet nie hoe die ander een werk nie.

2 jaar is in my opinie nie baie lank om te wag nie, hoekom so haastig?

You are indeed allowed to apply for any visa when you are on the SIR visa. So you could do what Aniena suggests. You would have to think about the cost of doing this. You would have to pay the whole application fee again and submit all the documents again.

You would apply for the offshore 136 visa. This has two implications

1 When your visa is granted you would have to go offshore to have it validated. (Think plane tickets)

2 If your SIR visa expires and no descision has been made on your application yet you would have to leave until the decision is made.

If you decide to do the SIR visa and stay and wait the two years the second phase of the application is an onshore application. This means you will be granted a bridging visa if your SIR expires and your PR application has not been decided yet. The PR application for SIR visa is also only AUD 185. Which is a lot cheaper than doing the whole application and having to pay for an offshore holiday to have it validated. Also you basically only do the Character and Health requirements as you are deemed to have met the other criteria.

Also doing the SIR visa is a hard visa but once you are here the time goes by quickly. So I agree with Annette why the rush ?

Hallo al julle nice mense! Ek het ook soortgelyke vrae.

Eerstens...wat is 'n SIR Visa?

Ek het laas maand my 136 Visa aansoek ingedien en die visa fooie is reeds afgetrek van my kredietkaart. Dit beteken die laaaang wag vir ons het begin. Alles verloop volgens plan.

Ek het egter van laasjaar af met 'n IT maatskappy in Sydney begin korrespondeer en hulle het nou vir my 'n Senior C# Programmeerder posisie. Na telefoniese korrespondensie het hulle besluit hulle wil my daar in hul firma hê. Met die inligting op die forum en dit wat ek van Ajay en Riekie kon kry het ek hulle van al die inligting voorsien wat nodig is om iemand op 'n 457 visa te sponsor. Die MD het selfs vir Ajay gekontak omdat sy alreeds mense help sponsor het. Sy kon hul bietjie in die regte rigting wys oor hoe om te werk te gaan.. Dankie Ajay!!! :ilikeit:

Hulle is nou vuur en vlam en wil my so gou as moontlik op 'n 457 visa oorbring na Sydney. Ons is nou in salaris onderhandeling. :) Ons enigste kwessie is dat ons dan duurder sal moet betaal vir die kinders se skoolgeld.

Wat ek egter wil weet is:

-Watter vorms moet ek nou vir DIMIA stuur om aan te dui dat ons voor die 136 visa goedkeuring reeds Oz toe kom en dat ons ook vir die 457 VISA gaan aansoek doen?

-As ek nou mediese toetse doen vir die 457, stuur ek dit dan net vir die 457 en moet ek dit weer doen vir die 136?

-Kan ek nou al vir polce clearance gaan en dit solank vir die 136 aanstuur. Ek meen, ek gaan dan mos reeds in Oz wees as dit sou verval en kon nie enige "oortredings" begaan het in SA nie. Want ek is dan al klaar daar?

-Laat DIMIA my dan weet wanneer ek die land moet verlaat om die 136 VISA stempel in my paspoort te kry? Wanneer reel mens dan jou NZ vakansie?

-Mens het seker dan 'n tydelike NZ visa nodig.

-Hoe lank vat hierdie NZ trip dan? Wat is die kortste tyd wat nodig is? Pos hulle dan die goedkeuring vir 'n Aussie konsulaat in NZ of wat?

Dink julle ek moet die kans vat? :ilikeit:

I am somewhat confused :ilikeit: by what you are saying. Below is a message that you sent me a while back with regards to a Skilled Independent Regional (495) Visa :ilikeit: .

Hi,

The 495 is a quick way of getting in. I thought I was being clever and after 1 (one) year I would apply for a 136 skilled independent visa. I was wrong the rules state that while you are here on the 495 you can not apply for any other visas. Meaning you are stuck here in SA for the 4 years, which is not a bad thing but for lawyers and marketing people I think Melbourne, Perth and Sydney will be more fun. You also need to take into consideration that even though there is a shortage of skilled workers you may find it difficult to gain employment, so you need to budget to be able to support yourself here for at least 6 months and maybe more. This money that you budget for that you must be willing to view it as gambling money. In my experience I have found that most couples between them have a job within a couple of months. Also remember that even menial work attracts a minimum wage which you can live on. So cleaning houses etc @ AUD 28 per hour is not bad.

I suggest you have your skills assessment done and work out the points you can get on the points test. If you have the required 100 points then apply for the sponsorship. The immigration SA website is very good and the people that work there are great. Have a look at www.immigration.sa.gov.au for info on living in SA and getting sponsorship. If however you are able to get the 120 points straight up then waiting the year that it takes DIMIA to process your independent visa may turn out to be a better option as you can then relocate anywhere in Aussie.

The idea behind the 495 and regional skilled visa is that once they have the skilled workforce they (SA government) can go after the work, sorta a chicken and egg situation.

Adelaide is a great place to live so once you are here you may not want to move!

According to my knowledge, the primary applicant is not allowed to apply for a Skilled Independent (136) visa whilst on a Skilled Independent Regional Visa (495), but the other visa holders of the Skilled Independent Regional Visa (495) will be in a position to apply for any other visa.

Die SIR Visa is:

A three (3) year visa for people unable to meet the Skilled Independent criteria, but who can meet the slightly lower pass mark for this visa. After living in a regional or low-population growth metropolitan area for two (2) years and working for at least 12 months in a regional or low-population growth metropolitan area, applicants can apply for a permanent visa. Applicants must be sponsored by a participating state/territory government.

When can you apply for a permanent visa?

You can apply for a permanent visa once you have:

• lived for two (2) years in regional Australia or a low population growth metropolitan area

and

•have worked, including self-employment, for 12 months in these same areas.

There is no restriction on the type of work that you may undertake. The only restriction is that the

employment must be both of the following:

•'full-time'

•undertaken in a regional or low population growth metropolitan area in Australia.

Hi Pippa,

After my message to you and the response you elicited from everyone both here and references to the BE expats forum I concluded that there is nothing stopping you from applying for a 136. So I should have agreed with you on that one way back, I humbly appologize. I had a chat to the people at a Seminar that was held by Immigration SA and ASPC they indicated that you are welcome to apply for any visa. They did however explain the whole offshore/onshore thing. Your second phase of SIR is onshore so you can get a bridging visa.

I still stand by my advice that if you can get the 120 points, then go for the PR 136 as a first price.

Also On the application form you have to indicate any other visas that you hold (question 52). So that may flag them to place you application in the back of the queue <---- Personnal opinion.

Baie dankie vir almal se raad. Om julle vraag te beantwoord. Ons is haastig om die tydelike visa om te sit in 'n permanente een omdat ek my meesters moet doen voordat ek kan begin werk. Dit is twee jaar voltyds en as mens op 'n 457 is betaal jy dubbeld vir die universiteits onkostes, en die ander ding wat ons bekommer is dat mens weet nie hoe verander dinge polities of medies of wat ook al in 2-3 jaar se tyd wat ons moet wat om 'n visa om te sit na 'n permanente visa nie. Net-nou moet ons weer terug en dit wil ons GLAD nie doen nie.

Al wat ek nog graag wil weet is kry mens punte omdat mens nou werk in Auz. Dus sal ons dan genoeg he vir 'n 136. ??? :ilikeit:

Dear Aniena,

May I suggest that you rephrase your question in English :ilikeit: ? We have two English Immigration Specialists (Fiona and Ptlabs) that might be able to answer your question if you write in English.

According to my knowledge you will be able to claim extra points after working for 2 years (I think) in Regional Australia. Maybe your best bet is to go for the SIR (495) and then apply for PR (136) after working in Regional Australia for a specific period of time.
