samum
Hi everyoneI wonder if anyone knows the answer to this one...We are renting a house, the owners said that they would consider selling and we would be keen to consider buying it. We are renting through an agent, does this mean that we would have to buy through the agent or could we deal with the owners directly? Not sure of the legal sides of things here in Aus...Thanks

The Real Estate Agent may only have an mandate to rent the house, in their capacity as Property Manager. If the owner has however given the Real Estate Agent an "exclusive" mandate to sell the house then you would have to deal with the nominated agent. The only person that can really answer your question is the owner(s).If you do not buy the house through and agent make sure that you appoint a lawyer than specialises in property sales to draw up the contract and/or a good conveyancer. Also have the house inspected for structural and other possible defects/problems.The maxim "Let the buyer beware" applies as much in Australia as it does in the RSA.EnjoyManny Edited July 9, 2009 by MannyT

rozellem
We had a similar situation in SA and the rental agent wanted to take the his cut, as if he did anything. Dont know about over here. Remember if the agent does want money, bargain him down. I mean, he did not launch a marketing campaign etc. to sell the property. Good luck.
