What happens when you have a 489 visa and apply for a 190 and its approved?

Hi. 

 

Need clarity please... 

 

We have applied for a 489 SA which is currently being processed, we have since received an invite for a 190 NSW, which we want to apply for? 

So what happens now? 

1. Does one override the other? 

2. If yes, which one? 

3. Will we have problems if we have a 489 granted when they start processing the 190? 

4. Can they decline processing the 190, when they see we already have state sponsorship on 489? 

5. If go and activate 489, and then 190 gets approved, how do we then activate the 190 if we are already onshore?

just wanted to understand you , do you have to pay again for the 190 visa ? or can you withdraw one & replace with another?

Hello PurpleFerri,

It is fine to have more than one visa application in the system at the same time.  You can however only have one visa at a time.  If the SC489 is granted before the SC190 then once the SC190 is granted the SC489 will cease.  The only thing you would need to worry about would be if the SC190 was granted and the SC489 was not yet granted as this could override the SC190 if the SC489 was subsequently granted - in this case you would need to withdraw the SC489 application as soon as the SC190 visa was granted.

 

I would advise against withdrawing the SC489 application before the SC190 was granted in case the SC190 was not granted for some reason.

Just to add a note depending upon how far you are along the state sponsorship 489 process.  Later this month (last day is 11 August) no more invitations will be made for people to apply for a 489 visa. 
It is important to note that the 491 visa which is replacing the 489 visa has a range of different visa Conditions - including that you would not be permit to apply for a 190 visa (and a range of other PR visa options) within the first 3 years of holding a 491 visa.
