ENS visa need advice please!

Been on 457 for the past 3years or so. In the process of applying for ENS. Nomination has been submitted and im halfway through my application online. Thing is i have a 2month old born here in sydney. I havent done his birth cert yet and havent added him to my 457 visa either. Wot do i do? Do i add him to the ENS app or not? He was born in oz but we still on 457 does that make him a temp res? If i submit my ens without including him and then do his birth cert will that make him a citizen? on the ens app it doesnt give any option for adding a dependant that was born in oz.. ive been searching forums and cant realy find a similar situation to go off of... Trying to avoid agent fees due to some unforeseen financial headaches. Any help wud be greatly appreciated...

As a 457 your baby has no citizenship right in Australia. He is a South African. You must add him to your ens.

So i have to apply for a south african passport for him just for the purpose of the application? Theres also no application fee to add him to my 457 because he was born here but will i have to pay to add him to ny ens?

Your child is stateless at the moment which is a real problem. I would think you should have halt the ENS application. Register the birth in RSA, get a South African passport for the child, add the child to your 457, then continue with the ENS application. But there may be a better way. Hopefull one of the forum agents will answer.

I had the SAME issue so can speak with authority. You need to get to Births and Deaths office and register your kid. You then need to add them to your 457. You CANNOT add them to your ENS until you have added them to your 457. I was told this in no uncertain terms. Once that is done, update your CO/VPO with the details you got, youre laughing. Make sure they are ONSHORE and not OFFSHORE, a simple but hard mistake to make.

The child is not actually Stateless, as laws provides for late condonation of birth registration, but unlike in SA where you can almost do it at 16, here in Aus they take a dim view to late registration. The child is implicitly a Saffer, but until they have formal documents it's not actually an issue until the child/parent needs/wants to travel. The persona non grata rule then kicks in. There is a movie about that, where a guy cruises the airport.

But you are all right, Welder, get your stuff together mate, a hard lesson from me as a former 457 holder, PLEASE don't leave it too late. Go now and get it sorted.

Thanx bro.. A relief coming from someone who was in same boat as i find myself in now. The whole process can get so confusing.

The ens nomination has alredy been submitted so i cant sleep on it but havent submitted my application yet. Alredy been procrastinating to long i shud hav got the ball rolling as soon as i found out my misses was pregs. So register him at births and deaths and add him to 457 will be step 1.. Is that all or will i need to apply for a south african unabridged birth cert and south african passport to add him to ens? And as i understand, i wont hav to pay to add him to 457 because he was born here, but will i hav to pay the thousand odd dollar fee to add him to the ENS?
