Partner/Marriage Visa

Hi

Yes, yes I have been missing in action for a while.

I need some advice for my newphew please.

He is back in Australia on my brothers PR visa, now he has to stay for 2 years and not able to leave the country.

Whilst back in RSA he met a girl, they got engaged.

The idea is that she come out sometime this year , they get married in Perth and then hopefully apply for a marriage visa .

My question is it possible to do this , she is on a SA passport, so not sure if her visa would allow this. Or would she need to leave the country go back to RSA and apply from there?

How long would the process take ( approximately) and the approximate costs?

What documents should she be getting together already now for this process to happen?

Any advice would be appreciated.

This can be a complex one, i would recommend getting one of the agents on the forums involved.

Bear this in mind when thinking about this situation, Auz has a proof of relationship thing in place, where you need to prove the number of years you have been living together, quite simply to prevent people from selling visa's via marriage.

If he is still PR not a citizen and doesnt have the 2 years living in a house with her sharing the bills it will be pretty hard i think.

Perhaps a long stay sponsored tourist (1 year) or a study visa to get her here and start building the 2 years history, the tourist visa will possibly have a no further stay and she will need to go back to RSA for a few months before the next one, the study option will be expensive, so bit of thought will need to go into it.

Definitely ask the advice of an agent though.

I would contact an agent, but ultimately you have to proof that your relationship is real and longlasting, and that is mostly through showing shared social circles, shared expenses, shared bills, medical aid, bank accounts, insurance policies, wills. The document explains the different categories and examples of proof you need. In the end, they want to see that you already have a life together, not that you PLAN to have these things once you are married unfortunately.

Edit: To clarify, the proof above is for a partner visa - for people who are already married. Prospective partner visas are different and have a different process and requirements as described in the document I linked.
