In our view, therefore there is no bar to an order that the ten per cent levy be repaid to Shuttleworth with interest. Having regard to the time that has elapsed between the commencement of the dispute between Shuttleworth and the Reserve Bank and the abolition of the ten per cent levy more than three years ago, there is no danger of a flood of similar claims.

So, before we get all excited and claim a refund, the judge opened a gate to flow funds back to Shuttleworth, yet he closed the floodgates we hoped for. But then, my legal friends nay have an opinion on the 3 year prescription where the underlying law was flawed!

Herewith the link to the actual judgment - interesting and easing reading. I felt like a pauper after counting them zeros! Could the judge not just use R165m as the newspaper chose to use?

I always got the feeling that Mark just didn't make the right friends in the ANC. The ANC is the dominent party because they know how to control the money.

FW De Klerk once wrote in a newspaper, something simmilar to

"The poor blacks are going to vote for the ANC because they want a good paying affirmitive action job. The wealthy blacks will vote ANC so they can keep their affirmitive action jobs."

Most people won't have read beteen the lines on the 2nd sentence. The DA will abolish affirmative action because it doesn't work. Now because AA is broken, undeserving black people have been put into good jobs or deserving black people have been promoted way beyond where they should be. Either way, those black people don't want the DA to be in power. Thats exactly what the ANC wants.

I think the same unnoficially applies to tax laws, foreign exchange laws, etc... the laws are left vague so the ANC can control the wealthy and force them to support the ANC financially.

Same thing with ANC taking KZN from the IFP. Why, it's a tribal Zulu factional voting bloc. The ANC need to shore up votes that are declining. Precisely the same model used by ZANU-PF. They used rural votes to beat the city guys who are closer to reality and see the BS. They know that if the DA get another metro it's game over. You can see the desperation in the statements and moves they are pulling. The reason they defend JZ is due to his Zulu pull in KZN. The switch from Xhosa leadership under Mandela and Mbeki to Zulu under Zuma is telling. His cabinet, now the worlds biggest if the stories are to be believed, are now some 70% Zulu as well. Tribalism at its good old African best. Same in Rwanda, same in Zim, same in Angola, see the pattern?

I do not believe for a second that the situation will improve. Nor will they ever give up power. Another simple yet brutally effective technique they have deployed to stay in power is the welfare state. Nobody who comes into power after them can stop it. It has created a fiscal drip in the vein of the economy that cannot be removed. But it in turn is draining the lifeblood out of the system. The end game is plain to see. But this is true for many countries.
