Tax Clearance For Emigration

If you are trying to sell me your services, thank you but no thanks, because I am wanting to hear from people with real life experiences in dealing with SARS to emigrate. (Apologies if this offends anyone)

My parents have recently emigrated to Australia to spend their retirement years with me, my sister and our families.

They left South Africa in April and it is now the end of July and they still have not got their tax clearance from SARS to allow them to transfer the allowed R8M on emigration.

Their 1st 2 applications for tax clearance were rejected for reasons that don't even make sense - eg saying my mom was a director of a company that she had nothing to do with. Finally on 22nd May the application got to the next stage where we received a list of questions to answer. We replied and have now been waiting 16 days for a response. We have built somewhat of a rapport with the person we replied to and he tells us that he will submit his report to his manager shortly.

My question is, has anyone else had a similar experience and if so what further time period can we expect before they are given the go ahead to transfer the funds?

Hey SARSProblems, I feel your pain. I have now been waiting almost 3 moths for our tax clearances to be finalised and we are only doing it for a measly R30k. In all honesty, with the amount of cash you are talking about I would contact Exchange4Free and get them to do the tax clearances and transfers for you, or if you don't want to do that do it through the foreign exchange department of your folks bank. SARS are a pain in the backside to deal with and unfortunately the foreign exchange controls in South Africa are ranked as some of the toughest in the world. I have a tax consultant in South Africa trying to get our tax clearances and she is having a hard time with SARS as well and she does this for a living.

I have been told that getting tax clearances for emigration purposes can take anything from 5 days to 18 months to get out of SARS depending on how much money you want to get out of RSA and how complex your financial affairs are. Good luck and I hope you get it sorted soon for your parents sake.

Hi SARSProblems, I considered trying to do the process myself but the more I got into it, I realized you need the services of real professionals. After many days of researching the forums, I decided to contact Cashkows and I have never regretted the decision since.
